Debt review is a legal process that's meant to protect you when debt becomes unmanageable. To cancel it, you must show that you financial situation has changed and that you can afford your repayments again. If that's the case, you can apply for a clearance certificate, which allows the debt review to be lifted from your credit profile. We'll help you determine whether you're ready to exit, and if you're not in a position to yet, we'll explore your options to get your financial situation back on track.
The sheriff can only take your belongings after a court has granted a valid judgement against you, and even then, there are rules to protect you. Essential household goods - like your bed, basic furniture, clothes, or tools you need for work - can't be taken. If the sheriff arrives, don't sign anything on the spot. Call us and we'll speak to the sheriff, check whether the attachment is lawful, and help you protect what you're legally entitled to keep.
The good news is that you cannot be arrested for owing money. Debt is a civil matter, not a criminal one. However, ignoring letters, summonses, or court dates can lead to a judgement against you, and that can have serious consequences - like money being deducted from your account or your belongings being take to be sold. When you fall behind on payments, the creditor can hand your account over to a debt collector to recover the money. They are allowed to contact you, but not to harass, threaten or pressure you into paying money you don't legally owe. If this happens, call us to check whether the debt is still valid - some older debts can't be collected anymore. If the debt is still due, we'll take over communication for you and work out repayment terms that realistically fits your budget
Yes, in many cases we can. A judgement can damage your credit record and make it hard to get a loan for a car or home, or even a cellphone contract. If the judgement was taken without your knowledge, or you've since paid the debt or the creditor agrees, we can help apply to have it removed (also known as a rescission of judgement). Once granted, we'll guide you through having the listing removed from your credit record.
