When someone dies, everything they owned and owed becomes their "estate". Before anyone can inherit, the estate needs to be formally reported to the Master's Office (whether there is a will or not). A person called the executor is then responsible for gathering information about your assets, paying any debts or final expenses, and making sure what remains goes to the right people. We'll guide your family through the process, so they don't have to navigate it alone during a difficult time.

The executor is the person who takes care of the legal and administrative steps involved in winding up the estate. You should nominate someone you trust in your will - a family member, close friend or a professional. If you don't have a will, the Master's Office will appoint a close family member to take on the role. Unlike some companies, LAW FORALL does not require you to appoint us as the executor. We believe that choice should always stay with you or your loved ones. Whoever takes on the role, we'll be there to guide and support them, so they understand what needs to be done, and never feel overwhelmed by the responsibility.

It all really depends on the size and complexity of the estate, and how quickly documents are submitted and approved by the Master's Office. Some estates can be finalised within a few months, while others may take longer, especially if there are delays with banks, SARS, or property transfers. What we can do is help keep the process moving by helping your family prepare and submit documents correctly, minimise back-and-forth with officials that often cause unnecessary delays. 

We don't replace the executor; instead, we work alongside them to guide and support them throughout the process. Your family will still play a part, especially when it comes to signing or submitting forms, and providing information only they would know, but they won't be left to figure out the process alone.

Your policy covers legal advice and assistance through the process; however, there are still some costs that apply to every estate - such as executor fees (unless they are waived), clearance certificates, property transfer and Deed Office fees, bank and other administrative charges. We'll make sure your family knows about these from the start, help them plan for them, and avoid unnecessary costs or surprises along the way.
