Frequently asked questions
about our bail & criminal defence benefit

Find answers to the questions we get asked most often about our policies and legal services.

We'll act quick as soon as you contact us, the SAPS must first process the case and charge you. Bail is then set by the Investigating Officer (for less serious matters) or a Magistrate in court. Our bail department will help you get home to your loved ones as quickly as possible but it can take a few hours or up to 48 hours if a bail hearing is necessary. If your policy covers bail, we'll arrange payment as soon as the amount is set or appoint a lawyer to apply for bail.

When someone you care about is in trouble, the first instinct is to help, and getting arrested can be stressful for everyone. The emergency line is always open to you as the policyholder, your spouse and dependent children, but unfortunately, your extended family are not covered under this benefit.

Good people make mistakes, and situations aren't always black-and-white, but criminal charges where drugs or alcohol are involved (like driving while under the influence) are often  seen as intentional, unlawful behaviour, which means they aren't covered under our policies. Every situation is different, so if you're unsure please give us a call. We'll look at your specific situation, talk through your policy and help you understand what support is available.

If you press charges or called as a witness in a criminal case, the state prosecutes the case for you - so you don't need your own defence lawyer. But that doesn't mean we won't have your back during this time: we can follow up with the SAPS on the progress of the case, raise complaints if you aren't getting updates or support, and ask the NPA to review their decisions if they decide not to prosecute.

Everyone deserves a second chance, especially if a past mistake holds you back form rebuilding your life. If you have a minor conviction, we can guide you through the expungement process - as long as you meet the legal requirements. We'll help you understand if you qualify, explain the process and documents needed, and how to  submit your request to the Department of Constitutional Development in Pretoria.
